Terms of Service

1. Service Description and Permitted Scope

Vibe3D provides an AI-powered visualization service that allows users to submit photos and inputs related to architecture, interior design, and exterior building design and receive AI-generated renders of the same. The Service is purpose-built and intended exclusively for architectural, interior design, and exterior building design workflows, including residential and commercial building visualization, space planning visualization, facade and elevation design, renovation and remodeling concepts, landscape and site design concepts, and related real-estate and architectural visualization use cases. We offer both pay-as-you-go credit packs and monthly subscription plans.

Any use of the Service outside of this Permitted Scope (as defined in Section 10) is not supported, is not licensed, and is expressly prohibited.

2. User Eligibility

You must be at least 16 years old to use the Service. By using the Service, you represent and warrant that you are at least 16 years of age.

3. User Accounts

To use our Service, you need to have a Google account. You are responsible for maintaining the confidentiality of your Google account and for all activities that occur under your account.

You may not share your login credentials with others or allow others to access your account. Each subscription plan is licensed to a single user. Team or multi-seat access requires an Enterprise plan.

4. Pay-As-You-Go Credits

• Credits are purchased as one-time packs and added to your account balance.
• Pay-as-you-go credits never expire as long as your account remains active.
• Credits are non-transferable between accounts.
• Credit packs may be refunded within 7 days of purchase if fewer than 10 credits have been used. Otherwise, all credit pack sales are final.

5. Subscription Plans

We offer monthly subscription plans that provide unlimited rendering subject to our Fair Usage Policy (Section 6). By subscribing, you authorize us to charge your payment method on a recurring basis every 30 days until you cancel.

• Billing cycle: 30 days from the date of purchase, auto-renewing until canceled.
• Failed payments: If a payment fails, we will retry for up to 3 days. If payment is not received, your subscription will be suspended and you will be downgraded to free-tier access.
• Cancellation: You may cancel at any time from your account settings. Cancellation takes effect at the end of your current billing cycle. You will retain subscription benefits until that date. No partial-month refunds are provided.
• Upgrades: Upgrading to a higher-tier plan is effective immediately. Any remaining days on your current cycle are prorated as credit toward the new plan.
• Downgrades: Downgrading to a lower-tier plan takes effect at the start of your next billing cycle.
• Price changes: We may adjust subscription prices with at least 15 days' notice. Existing subscribers are grandfathered at their current rate for at least 12 months unless they change plans.

6. Fair Usage Policy

Our "unlimited" subscription plans are designed for normal professional use by a single user. To maintain service quality for all customers, the following applies:

• Normal use: Unlimited rendering is provided for standard professional workflows. If your sustained usage significantly exceeds typical subscriber patterns and begins to degrade service for others, we may apply queue throttling or reduced priority. You will always be able to render; speed may be adjusted.
• Concurrent jobs: We may limit the number of renders that can be processed simultaneously to ensure platform stability. Enterprise plans may have adjusted concurrency arrangements.
• Prohibited use: Automated scripts, bots, scraping, reselling account access, shared logins across organizations, or any activity designed to circumvent normal usage patterns are prohibited and may result in account suspension.
• Abuse: We reserve the right to suspend or terminate accounts for usage patterns that we reasonably determine to be abusive, fraudulent, or intended to exploit the unlimited nature of the plan.

This policy exists to protect the experience of all users. If your legitimate workflow requires higher volume or concurrency, please contact us at hello@vibe3d.ai to discuss an Enterprise arrangement.

7. Refund Policy

• Pay-as-you-go credits: Refundable within 7 days of purchase if fewer than 10 credits have been used. Otherwise, all credit sales are final.
• Subscriptions: No refunds for partial months. Full refund available within 48 hours of first purchase if zero subscription credits have been used. After 48 hours or any usage, the subscription month is non-refundable.
• Chargebacks: Filing a chargeback without first contacting us for resolution is a breach of these Terms and will result in immediate account termination.

8. User Content

Our Service allows you to submit photos and information ("User Content"). By submitting User Content to our Service, you:

• Grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content for the purpose of providing and improving our Service.
• Represent and warrant that you own or have the necessary rights to such User Content and that it does not violate the rights of any third party.
• Understand that we do not claim ownership of your User Content.

9. AI Output and Intellectual Property

AI-generated interior designs provided through our Service are for visualization purposes only. Vibe3D does not guarantee the accuracy, feasibility, or safety of implementing these designs in real life. Users should consult with professional interior designers or contractors before implementing any designs.

• You retain ownership of your original inputs (uploads, sketches, prompts).
• You own the AI-generated outputs (renders) you create, subject to compliance with these Terms.
• We do not use your uploads or outputs to train or fine-tune our own AI models.
• Third-party AI providers may process your content per their own terms and privacy policies.
• Similar or identical outputs may be generated for other users based on similar inputs.

10. Prohibited Uses

The Service is designed and licensed solely for architectural, interior design, and exterior building design use cases (the "Permitted Scope"). You agree not to use the Service, and not to submit any input or prompt or generate any output, for any purpose outside the Permitted Scope, including but not limited to:

• Out-of-scope use: Using the Service for any purpose that is not architecture, interior design, or exterior building design. This includes, without limitation, creating animations, video series, films, television, streaming content, motion graphics, animated storytelling, character animation, cartoon or episodic content, video-game assets or cutscenes, music videos, advertisements or promotional videos, YouTube videos, short-form videos, social media video content, or any audiovisual or animated content; as well as using the Service for product, packaging, fashion, graphic, logo, textile, industrial, jewelry, vehicle, or character design, for general image generation, photo editing, avatar or portrait generation, medical, scientific, educational, or engineering illustration, or for any other non-architectural visualization purpose.
• Mischaracterization of outputs: Presenting, selling, distributing, or publishing outputs generated through the Service as something other than architectural, interior, or exterior design renders, or using such outputs as source material, frames, or assets for any out-of-scope product, media, or service.
• In any way that violates any applicable law or regulation.
• To submit content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable.
• To impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity.
• To engage in any activity that interferes with or disrupts the Service.
• To attempt to circumvent any security measures or usage limits of the Service.
• To share account credentials, resell access, or use automated tools or scripts.
• To upload client materials, proprietary designs, or confidential content unless you have all necessary rights and consents.

Because the Service is not built, tested, or intended for out-of-scope use, Vibe3D provides no warranty, guarantee, or support for any output produced outside the Permitted Scope. Outputs generated outside the Permitted Scope are produced in breach of these Terms, do not carry any license from Vibe3D, and may be removed, revoked, or render your account liable to suspension under Section 14. If you are uncertain whether a use case falls within the Permitted Scope, contact us at hello@vibe3d.ai before using the Service.

11. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Vibe3D and its licensors. The Service is protected by copyright, trademark, and other laws.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

13. Limitation of Liability

To the maximum extent permitted by law, Vibe3D shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid to us in the 12 months before the event giving rise to the claim, or (b) USD $100.

14. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for:

• Material breach of these Terms
• Abusive usage patterns or Fair Usage Policy violations
• Payment fraud or chargebacks
• Illegal or harmful content uploads

For general discontinuation of service, we will provide at least 30 days' notice. Upon termination, your data will be retained for 30 days then purged, except where legal obligations require longer retention.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after changes constitutes acceptance.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Gujarat, India, without regard to its conflict of law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat.
